Das online Reisebüro Kiwi aus Brno hat ja schon ein wenig legendären Status. Sie fügen Flüge aneinander, die so eigentlich gemeinsam nicht verkauft werden. Prinzipiell wird von Kiwi eine Art Garantie aufs Funktionieren dieser Flüge und Verbindungen gegeben. Die Berichte über Kiwi sind durchwachsen positiv und negativ.

Die Kiwi Garantie deckt doch viele Zustände. Verpasst man z. B. eine über Kiwi gebuchte Verbindung (die es ja eigentlich gar nicht gibt), dann bucht Kiwi einen neuen Flug und übernimmt die Kosten.

Das Verfallenlassen des letzten Fluges macht bekanntlich mitunter den Preis günstiger. Es widerspricht aber möglicherweise den Bedingungen der Airline und könnte zu einer Neuberechnung des Flugpreises führen. Kiwi hat seinen Kunden nun eine Email mit einer Zusicherung von Rechtsbeistand zukommen lassen. Wer seinen letzten Flug verpasst und über Kiwi gebucht hat, bekommt nun eine neue Garantie:

“With the recent news that airlines are continuing to sue their own customers, we’re extending our protection. Now, if you book an itinerary with Kiwi.com and an airline unreasonably decides you’re in breach, we’ll reimburse the amount claimed back, your legal costs, or provide assistance.
We will provide You with the below-specified assistance in situations when a legal claim is brought against You by the Selected Carrier in relation to Your Booking due to the alleged breach of the Selected Carrier’s contractual clauses which are considered as unbalanced, disproportionate and/or abusive. These conditions include, among others, the practices commonly known as “throw-away”, “back to back” and “hidden city” ticketing. We believe that these and similar contractual clauses are disproportionate and thus shall not enjoy legal protection.
In case the Selected Carrier brings a lawsuit against You claiming a breach of these contractual clauses, We will:
(1) Reimburse You the costs of Your legal expenses related to such legal proceedings; or
(2) Assist You in the legal proceedings and provide You with the aid of Our legal advisors who are experienced with claims of this nature; or
(3) Reimburse You the amount claimed by the Selected Carrier in relation to the alleged breach of its contractual clauses.
The choice of the appropriate and most suitable method and scope of Our assistance will be done upon Our discretion following a previous consultation with You.
In order to provide You with the above-specified assistance, We need You to contact Us immediately after You are contacted by the Selected Carrier when they claim such a breach. And You must provide Us with all the relevant information and necessary cooperation so that We are able to find the appropriate solution to Your situation both timely and accurately.”

“Kiwi.com has announced it will provide assistance in case legal action is taken against its customers for alleged breach of unreasonable terms of the airlines, namely so called throwaway ticketing and similar practices.
It was recently revealed by CNN that Lufthansa is suing a customer for using a discounted fare, as other airlines have done in the past.
The contract of carriage that airlines use may often be confusing — and can lead to legal consequences that are unreasonable.
If a customer travelling with tickets bought through Kiwi.com finds themselves on the receiving end of such unreasonable actions, the company will offer assistance to its customers in such lawsuits and, if reasonable for the solution of the case after prior agreement with Kiwi.com, also cover legal fees.
Kiwi.com says it would like to clear the waters surrounding contracts of carriage and the consumers’ right to choose how they use the product they purchase.
Oliver Dlouhý, Kiwi.com’s CEO, said: “At Kiwi.com we want to make travel better for everyone.
“We want to make it clear that we will always stay on the side of our customers in relation to predatory behaviour while making sure they always have access to the best deals.”
David Liškutin, Chief Legal Officer at Kiwi.com, said: “The legal situation related to certain airline’s conditions of carriage is confusing and complicated for travellers, and it is hard to foresee certain legal outcomes of their travel behaviour.
“We hold a rather liberal point of view because we trust in free will and the right to free choice in respect to the use of the product customers purchase from service providers, including airlines.
“We think that customers should have the liberty to choose whether they will use the service and to what extent, without the risk of being penalised.
“In this regard, we offer them our aid in the case they are sued for exercising their right to free choice.”
Dlouhý continued: “Our customers are always at the front of our minds — even if it means helping them in the legal area in cases such as these.
“We know much of the travel industry is broken and built on archaic structures that benefit the big players. We want to be part of the solution, not the problem, and invite everyone to join us in a common goal — making travel better.””

    Habe schon bei OMAAT kommentiert, Kiwi.com ist bekanntermaßen eine so EXTREM unseriöse Bude, die werden NIEMANDEN verteidigen.

    Deren eigene Garantie ist ein Witz: “Wenn Sie Ihren Anschluss auf separatem Ticket verpassen, dann buchen wir Sie um oder Sie erhalten Ihr Geld zurück. Außer uns ist das zu teuer. Dann halt nicht.”

    Das Internet ist voll mit Horrorstories zu denen. Wer da bucht, ist selbst schuld.
    Bitte dafür keine Werbung machen.

      Verwandte hatte mal einen Kiwi Flug.
      Ryanair mit Anschluss zu Easyjet.

      Ryanair hat bekanntlich gestreikt letztes Jahr.. Kiwi hat überhaupt nichts umgebucht.. keine Assistance – Also haben wir selbst auf Lufthansa umgebucht (waren dann horrende 400€ für Kurzstrecke Oneway..

      Wenn man am nächsten Tag dringend wo hin muss, dann hat man auch keine Zeit/Lust sich jetzt mit Kiwi auseinanderzusetzen.

      Wir werden auf jeden Fall niemals wieder über Kiwi buchen.

    2. Ordnet sich in die Kiwi Horror Stories aus dem Internet ein. Das dürfte bei ihnen ein Klassiker sein.

      Letztlich werden sie juristisch das sogar übernehmen müssen. Wenn sie Hidden City Tickets (was sie ja mitunter auch machen) verkaufen und es dem Kunden nicht sagen.

  2. Kann die ganze LH Geschichte nicht hören. Der Typ war einfach dumm einen separaten LH Flug gebucht zu haben. Daher auch doppelt im System und zu beweisen.
